N\u00e1jomn\u00fa zmluvu bude mo\u017en\u00e9 skon\u010di\u0165 aj v\u00fdpove\u010fou zo strany ktorejko\u013evek zmluvnej strany, s&nbsp;v\u00fdpovednou dobou 4 mesiace. Vyhlasovate\u013e si vyhradzuje pr\u00e1vo s\u00fa\u0165a\u017e zru\u0161i\u0165 a&nbsp;neuzatvori\u0165 zmluvu, a&nbsp;to aj bez udania d\u00f4vodu.<\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong>\u00da\u010del n\u00e1jmu:<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Poskytovanie slu\u017eieb v&nbsp;oblasti ob\u010derstvenia.<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li><strong>\u00daprava a\u00a0vybavenie predmetu n\u00e1jmu:<\/strong><\/li>\n<\/ol>\n\n\n\n<p>N\u00e1jomca zabezpe\u010d\u00ed \u00fapravu a&nbsp;vybavenie predmetu n\u00e1jmu na vlastn\u00e9 n\u00e1klady. \u00daprava predmetu n\u00e1jmu mus\u00ed ma\u0165 reverzibiln\u00fd charakter. The submitted proposal cannot be changed or supplemented, nor modified after the deadline for submitting tender proposals.<\/p>\n\n\n\n<p>Objekt je evidovan\u00fd v&nbsp;\u00dastrednom zozname pamiatkov\u00e9ho fondu, vedenom Pamiatkov\u00fdm \u00faradom Slovenskej republiky pod \u010d. 1273 ako n\u00e1rodn\u00e1 kult\u00farna pamiatka. N\u00e1jomca je obozn\u00e1men\u00fd s&nbsp;t\u00fdmto pr\u00e1vnym statusom, preto ak\u00e9ko\u013evek \u00fakony podliehaj\u00face schv\u00e1leniu Krajsk\u00e9ho pamiatkov\u00e9ho \u00faradu Tren\u010d\u00edn si hrad\u00ed a&nbsp;vybavuje n\u00e1jomca s\u00e1m.<\/p>\n\n\n\n<p>V&nbsp;predmete n\u00e1jmu je mo\u017en\u00e9 vykona\u0165 obhliadku v&nbsp;pr\u00edtomnosti kontaktnej osoby vyhlasovate\u013ea v&nbsp;term\u00edne dohodnutou s&nbsp;touto kontaktnou osobou.<\/p>\n\n\n\n<p>S\u00fa\u0165a\u017en\u00fd n\u00e1vrh m\u00f4\u017ee by\u0165 doru\u010den\u00fd osobne do podate\u013ene vyhlasovate\u013ea v&nbsp;zalepenej ob\u00e1lke s&nbsp;uveden\u00edm mena a&nbsp;po\u0161tovej adresy \u00fa\u010dastn\u00edka s&nbsp;ozna\u010den\u00edm:&nbsp;<strong>\u201eObchodn\u00e1 verejn\u00e1 s\u00fa\u0165a\u017e na pren\u00e1jom nebytov\u00fdch priestorov v&nbsp;Dra\u0161kovi\u010dovom ka\u0161tieli \u2013 Neotv\u00e1ra\u0165\u201c<\/strong>&nbsp;v&nbsp;pracovn\u00fdch d\u0148och do 25.05.2026 do 10:00 hod. alebo zasla\u0165 po\u0161tou na adresu vyhlasovate\u013ea s&nbsp;horeuveden\u00fdm ozna\u010den\u00edm na ob\u00e1lke tak, aby ponuka bola zaevidovan\u00e1 v&nbsp;podate\u013eni vyhlasovate\u013ea do 25.05.2026 do 10:00 hod. Spolo\u010dn\u00e1 rozloha predmetu n\u00e1jmu je 165,77 m<sup>2<\/sup>. Predmet n\u00e1jmu je vyzna\u010den\u00fd na p\u00f4doryse, ktor\u00fd tvor\u00ed pr\u00edlohu \u010d. 1 k tejto zmluve.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 2) S\u00fa\u010das\u0165ou predmetu n\u00e1jmu je aj technick\u00e9 kuchynsk\u00e9 vybavenie, zoznam ktor\u00e9ho je uveden\u00fd v&nbsp;pr\u00edlohe \u010d. 2 k&nbsp;tejto zmluve.<\/p>\n\n\n\n<p><strong>\u010cl. III<\/strong><\/p>\n\n\n\n<p><strong>Lease Duration<\/strong><\/p>\n\n\n\n<p>T\u00e1to zmluva sa uzatv\u00e1ra na&nbsp;<strong><em>dobu ur\u010dit\u00fa v trvan\u00ed 5 rokov, a&nbsp;to od&nbsp;<\/em><\/strong><strong><em>xx.xx.2026 do&nbsp;<\/em><\/strong><strong><em>xx.xx.2031.<\/em><\/strong><\/p>\n\n\n\n<p><strong>\u010cl. IV<\/strong><\/p>\n\n\n\n<p><strong>Purpose of the Lease<\/strong><\/p>\n\n\n\n<p>N\u00e1jomca sa zav\u00e4zuje vyu\u017e\u00edva\u0165 predmet n\u00e1jmu v\u00fdlu\u010dne na prev\u00e1dzku poskytovanie slu\u017eieb v oblasti ob\u010derstvenia.<\/p>\n\n\n\n<p><strong>\u010cl. V<\/strong><\/p>\n\n\n\n<p><strong>N\u00e1jomn\u00e9 a platobn\u00e9 podmienky<\/strong><\/p>\n\n\n\n<p>1) Zmluvn\u00e9 strany sa dohodli na mesa\u010dnom n\u00e1jomnom vo v\u00fd\u0161ke XX,- \u20ac \/ 1m\u00b2, \u010do predstavuje celkov\u00e9 n\u00e1jomn\u00e9 vo v\u00fd\u0161ke XXX,- \u20ac (slovom: XXX eur)&nbsp;<strong>mesa\u010dne<\/strong>. V n\u00e1jomnom nie s\u00fa zahrnut\u00e9 n\u00e1klady na energie (elektrina a voda), za ktor\u00e9 bude n\u00e1jomca uhr\u00e1dza\u0165 z\u00e1lohov\u00fa platbu XXX \u20ac (slovom: XXX eur) mesa\u010dne. &nbsp;<\/p>\n\n\n\n<p>2) Prenaj\u00edmate\u013e nav\u00fd\u0161i ka\u017ed\u00fd kalend\u00e1rny rok v\u00fd\u0161ku n\u00e1jomn\u00e9ho dohodnut\u00e9ho v ods. 1 v nadv\u00e4znosti na cenov\u00fd v\u00fdvoj o priemern\u00fa ro\u010dn\u00fa mieru infl\u00e1cie v Slovenskej republike meran\u00fa indexom spotrebite\u013esk\u00fdch cien za predch\u00e1dzaj\u00faci kalend\u00e1rny rok stanoven\u00fa \u0160tatistick\u00fdm \u00faradom Slovenskej republiky, najmenej v\u0161ak v\u017edy vo v\u00fd\u0161ke 5% ( slovom: p\u00e4\u0165 percent). Z\u00e1kladom pre zvy\u0161ovanie n\u00e1jomn\u00e9ho je v\u00fd\u0161ka platn\u00e9ho n\u00e1jomn\u00e9ho za jeden mesiac predch\u00e1dzaj\u00faci kalend\u00e1rny rok.<\/p>\n\n\n\n<p>3) Ro\u010dn\u00e9 vy\u00fa\u010dtovanie energi\u00ed bude n\u00e1jomcovi predlo\u017een\u00e9 do 31.03. roku nasleduj\u00faceho po roku, na ktor\u00fd sa vy\u00fa\u010dtovanie vz\u0165ahuje, a to na z\u00e1klade odpisu, realizovan\u00e9ho ku d\u0148u 31.12. tohto roku. N\u00e1klady za teplo bud\u00fa n\u00e1jomcovi fakturovan\u00e9 v alikvotnej v\u00fd\u0161ke v pomere plochy, vyu\u017e\u00edvanej n\u00e1jomcom vo vz\u0165ahu k celkovej ploche objektu administrat\u00edvnej budovy. Preplatok na energi\u00e1ch a teple bude n\u00e1jomcovi uhraden\u00fd do 30 dn\u00ed na jeho zmluvn\u00fd \u00fa\u010det, nedoplatok na energi\u00e1ch a teple sa n\u00e1jomca zav\u00e4zuje uhradi\u0165 na z\u00e1klade fakt\u00fary, vystavenej prenaj\u00edmate\u013eom.<\/p>\n\n\n\n<p>4) Prenaj\u00edmate\u013e nie je platcom DPH. N\u00e1jomca je\/nie je platcom DPH.<\/p>\n\n\n\n<p>5) N\u00e1jomca sa zav\u00e4zuje zaplati\u0165 \u00fahradu vo v\u00fd\u0161ke pod\u013ea ods. 1 na z\u00e1klade fakt\u00fary, vystavenej prenaj\u00edmate\u013eom, splatnos\u0165 ktorej bude 15 dn\u00ed.<\/p>\n\n\n\n<p>6) \u00dahrada sa pova\u017euje za uhraden\u00fa momentom jej prip\u00edsania na \u00fa\u010det prenaj\u00edmate\u013ea.<\/p>\n\n\n\n<p><strong>\u010cl. VI<\/strong><\/p>\n\n\n\n<p><strong>Podmienky prev\u00e1dzky<\/strong><\/p>\n\n\n\n<p>1) N\u00e1jomca je povinn\u00fd zabezpe\u010di\u0165 re\u017eim prev\u00e1dzky kaviarne v predmete n\u00e1jmu tak, aby boli splnen\u00e9 nasledovn\u00e9 podmienky:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>a) reklamn\u00e9 a propaga\u010dn\u00e9 zariadenia a tabule musia by\u0165 schv\u00e1len\u00e9 Krajsk\u00fdm pamiatkov\u00fdm \u00faradom Tren\u010d\u00edn a prenaj\u00edmate\u013eom,<\/li>\n\n\n\n<li>b) interi\u00e9rov\u00e9 rie\u0161enie je v kompetencii n\u00e1jomcu, pr\u00edpadn\u00e9 modifik\u00e1cie priestorov v\u0161ak musia ma\u0165 zvratn\u00fd charakter tak, aby pri skon\u010den\u00ed zmluvy bol predmet n\u00e1jmu odovzdan\u00fd v stave, v akom bol pri jeho preberan\u00ed, s prihliadnut\u00edm na primeran\u00e9 opotrebenie,<\/li>\n\n\n\n<li>c) z\u00e1sobovanie prev\u00e1dzky motorov\u00fdmi vozidlami mus\u00ed by\u0165 realizovan\u00e9 v\u00fdhradne mimo otv\u00e1rac\u00edch hod\u00edn Dra\u0161kovi\u010dovho ka\u0161tie\u013ea, t.j. tak, aby sa po\u010das otv\u00e1rac\u00edch hod\u00edn Dra\u0161kovi\u010dovho ka\u0161tie\u013ea nenach\u00e1dzali v are\u00e1li Dra\u0161kovi\u010dovho ka\u0161tie\u013ea \u017eiadne z\u00e1sobovacie ani in\u00e9 motorov\u00e9 vozidl\u00e1 ani in\u00e9 zariadenia, ktor\u00e9 by br\u00e1nili n\u00e1v\u0161tevn\u00edkom v\u00a0pr\u00edstupe do are\u00e1lu ka\u0161tie\u013ea alebo in\u00fdm sp\u00f4sobom zni\u017eovali n\u00e1v\u0161tevn\u00edcky komfort,<\/li>\n\n\n\n<li>d) vstup do are\u00e1lu Dra\u0161kovi\u010dovho ka\u0161tie\u013ea bude n\u00e1jomcovi umo\u017enen\u00fd na z\u00e1klade k\u013e\u00fa\u010dov, vydanej prenaj\u00edmate\u013eom a k\u013e\u00fa\u010dov od br\u00e1ny. Vyhotovenie k\u00f3pie \u010dipovej karty alebo k\u013e\u00fa\u010dov alebo ich zneu\u017eitie na umo\u017enenie vstupu tret\u00edm osob\u00e1m je d\u00f4vodom na ich od\u0148atie a bezodkladn\u00e9 ukon\u010denie zmluvy,<\/li>\n\n\n\n<li>e) n\u00e1jomca zabezpe\u010d\u00ed odvoz odpadov, vzniknut\u00fdch v s\u00favislosti s\u00a0prev\u00e1dzkou na vlastn\u00fa zodpovednos\u0165 tak, aby tento nebol realizovan\u00fd na \u00fakor prenaj\u00edmate\u013ea,<\/li>\n\n\n\n<li>f) n\u00e1jomca je povinn\u00fd zabezpe\u010dova\u0165 v predmete n\u00e1jmu poriadok, vr\u00e1tane priebe\u017en\u00e9ho upratovania pou\u017eit\u00fdch obalov,<\/li>\n\n\n\n<li>g) v pr\u00edpade z\u00e1ujmu n\u00e1jomcu o vyu\u017eitie predmetu n\u00e1jmu na in\u00fd \u00fa\u010del ako je uveden\u00e9 v zmluve (napr. organiz\u00e1cia kult\u00farneho podujatia) je n\u00e1jomca povinn\u00fd uzavrie\u0165 s prenaj\u00edmate\u013eom osobitn\u00fa zmluvu,<\/li>\n\n\n\n<li>h) za svoje alebo cudzie veci, umiestnen\u00e9 alebo do\u010dasne ulo\u017een\u00e9 v predmete zmluvy zodpoved\u00e1 n\u00e1jomca.<\/li>\n<\/ol>\n\n\n\n<p><strong>\u010cl. VII<\/strong><\/p>\n\n\n\n<p><strong>Pr\u00e1va a povinnosti zmluvn\u00fdch str\u00e1n<\/strong><\/p>\n\n\n\n<p>1) Prenaj\u00edmate\u013e m\u00e1 pr\u00e1vo:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>a) na n\u00e1hradu \u0161kody na veciach, ktor\u00e9 n\u00e1jomca po\u0161kodil alebo zni\u010dil svoj\u00edm konan\u00edm,<\/li>\n\n\n\n<li>b) na n\u00e1hradu zv\u00fd\u0161en\u00fdch n\u00e1kladov, sp\u00f4soben\u00fdch konan\u00edm n\u00e1jomcu nad r\u00e1mec tejto zmluvy.<\/li>\n<\/ol>\n\n\n\n<p>2) Prenaj\u00edmate\u013e je povinn\u00fd:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>a) umo\u017eni\u0165 n\u00e1jomcovi bezplatn\u00fd vstup do are\u00e1lu Dra\u0161kovi\u010dovho ka\u0161tie\u013ea;<\/li>\n\n\n\n<li>b) umo\u017eni\u0165 n\u00e1jomcovi vjazd osobn\u00e9ho automobilu vo vlastn\u00edctve n\u00e1jomcu do are\u00e1lu Dra\u0161kovi\u010dovho ka\u0161tie\u013ea; automobil mus\u00ed opusti\u0165 are\u00e1l ka\u0161tie\u013ea pred za\u010dat\u00edm otv\u00e1rac\u00edch hod\u00edn.<\/li>\n<\/ol>\n\n\n\n<p>3) N\u00e1jomca je okrem povinnost\u00ed, upraven\u00fdch v \u010dl. VI povinn\u00fd:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>a) vykon\u00e1va\u0165 svoje aktivity tak, aby neboli ohrozen\u00e9 alebo po\u0161koden\u00e9 pamiatkov\u00e9 hodnoty predmetu n\u00e1jmu, ako aj cel\u00e9ho are\u00e1lu Dra\u0161kovi\u010dovho ka\u0161tie\u013ea,<\/li>\n\n\n\n<li>b) vyu\u017e\u00edva\u0165 predmet n\u00e1jmu v\u00fdlu\u010dne na \u00fa\u010del uveden\u00fd v \u010dl. IV,<\/li>\n\n\n\n<li>c) zabezpe\u010di\u0165 bezpe\u010dnos\u0165 os\u00f4b, vyu\u017e\u00edvaj\u00facich v jeho mene predmet n\u00e1jmu,<\/li>\n\n\n\n<li>d) dodr\u017eiava\u0165 bezpe\u010dnostn\u00e9 predpisy a predpisy v oblasti ochrany pred po\u017eiarmi,<\/li>\n\n\n\n<li>e) riadne a v\u010das nahradi\u0165 ak\u00e9ko\u013evek zv\u00fd\u0161en\u00e9 n\u00e1klady, sp\u00f4soben\u00e9 svoj\u00edm konan\u00edm, ako aj \u0161kodu, ktor\u00e1 prenaj\u00edmate\u013eovi vznikla v s\u00favislosti s jeho konan\u00edm,<\/li>\n\n\n\n<li>f) vykon\u00e1va\u0165 svoje komer\u010dn\u00e9 aktivity v are\u00e1li Dra\u0161kovi\u010dovho ka\u0161tie\u013ea v\u00fdhradne na prenaj\u00edmate\u013eom ur\u010denom mieste, ktor\u00fdm je priestor definovan\u00fd v \u010dl. II,<\/li>\n\n\n\n<li>h) po skon\u010den\u00ed zmluvy bezodkladne vyprata\u0165 predmet n\u00e1jmu a priestory uvies\u0165 do p\u00f4vodn\u00e9ho stavu,<\/li>\n\n\n\n<li>i) riadne a v\u010das uhr\u00e1dza\u0165 fakt\u00fary, vyd\u00e1van\u00e9 prenaj\u00edmate\u013eom,<\/li>\n\n\n\n<li>j) riadne sa stara\u0165 o\u00a0vybavenie, uveden\u00e9 v\u00a0\u010dl. II ods. 2 a\u00a0vyu\u017e\u00edva\u0165 ho sp\u00f4sobom primeran\u00fdm \u00fa\u010delu zmluvy.<\/li>\n<\/ol>\n\n\n\n<p>4) N\u00e1jomca nesmie:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>a) vykon\u00e1va\u0165 svoje komer\u010dn\u00e9 aktivity na inom ako prenaj\u00edmate\u013eom ur\u010denom mieste,<\/li>\n\n\n\n<li>b) bez v\u00fdslovn\u00e9ho s\u00fahlasu prenaj\u00edmate\u013ea post\u00fapi\u0165 predmet n\u00e1jmu do podn\u00e1jmu tretej osobe.<\/li>\n<\/ol>\n\n\n\n<p>5) N\u00e1jomca zodpoved\u00e1 za n\u00e1sledky poru\u0161enia z\u00e1kona \u010d. 49\/2002 Z. z. o ochrane pamiatkov\u00e9ho fondu v znen\u00ed neskor\u0161\u00edch predpisov svoj\u00edm konan\u00edm.<\/p>\n\n\n\n<p><strong>\u010cl. VIII<\/strong><\/p>\n\n\n\n<p><strong>Sankcie<\/strong><\/p>\n\n\n\n<p>1) V pr\u00edpade poru\u0161enia povinnost\u00ed n\u00e1jomcu, ur\u010den\u00fdch v \u010dl. VI a \u010dl. VII ods. 4 a 5 sa n\u00e1jomca zav\u00e4zuje prenaj\u00edmate\u013eovi zaplati\u0165 zmluvn\u00fa pokutu vo v\u00fd\u0161ke 200 \u20ac (slovom: dvesto eur) za ka\u017ed\u00e9 poru\u0161enie povinnosti, a to do 10 dn\u00ed od doru\u010denia p\u00edsomnej v\u00fdzvy, ak nie je v tejto zmluve ur\u010den\u00e9 inak.<\/p>\n\n\n\n<p>2) Opakovan\u00e9 poru\u0161enie povinnost\u00ed n\u00e1jomcu, ur\u010den\u00fdch v \u010dl. VI a \u010dl. VII ods. 4 a 5 m\u00f4\u017ee by\u0165 d\u00f4vodom na podanie v\u00fdpovede zo strany prenaj\u00edmate\u013ea.<\/p>\n\n\n\n<p><strong>\u010cl. IX<\/strong><\/p>\n\n\n\n<p><strong>Z\u00e1nik zmluvy<\/strong><\/p>\n\n\n\n<p>1) T\u00e1to zmluva zanik\u00e1:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>a) skon\u010den\u00edm doby, na ktor\u00fa bola dojednan\u00e1,<\/li>\n\n\n\n<li>b) v\u00fdpove\u010fou,<\/li>\n\n\n\n<li>c) vz\u00e1jomnou dohodou,<\/li>\n\n\n\n<li>d) smr\u0165ou alebo z\u00e1nikom jednej zo zmluvn\u00fdch str\u00e1n.<\/li>\n<\/ol>\n\n\n\n<p>2) V\u00fdpove\u010f a vz\u00e1jomn\u00e1 dohoda musia ma\u0165 p\u00edsomn\u00fa formu, inak s\u00fa neplatn\u00e9. Zmluvu mo\u017eno vypoveda\u0165 na z\u00e1klade d\u00f4vodov, upraven\u00fdch v \u00a7 9 ods. 2 a 3 z\u00e1kona \u010d. 116\/1990 Zb. o n\u00e1jme a podn\u00e1jme bytov a nebytov\u00fdch priestorov v znen\u00ed neskor\u0161\u00edch predpisov, prenaj\u00edmate\u013e m\u00f4\u017ee zmluvu vypoveda\u0165 aj na z\u00e1klade \u010dl. VIII ods. 2 tejto zmluvy. V\u00fdpovedn\u00e1 doba je dvojmesa\u010dn\u00e1 a za\u010d\u00edna plyn\u00fa\u0165 od prv\u00e9ho d\u0148a mesiaca, nasleduj\u00faceho po mesiaci, kedy bola v\u00fdpove\u010f doru\u010den\u00e1 druhej strane.<\/p>\n\n\n\n<p><strong>\u010cl. X<\/strong><\/p>\n\n\n\n<p><strong>Z\u00e1vere\u010dn\u00e9 ustanovenia<\/strong><\/p>\n\n\n\n<p>1) T\u00fato zmluvu je mo\u017en\u00e9 zmeni\u0165 len p\u00edsomn\u00fdmi dodatkami, podp\u00edsan\u00fdmi oboma zmluvn\u00fdmi stranami.<\/p>\n\n\n\n<p>2) Pr\u00e1va a povinnosti zmluvn\u00fdch str\u00e1n, neupraven\u00e9 touto zmluvou sa riadia pr\u00edslu\u0161n\u00fdmi ustanoveniami z\u00e1kona o n\u00e1jme a podn\u00e1jme nebytov\u00fdch priestorov a z\u00e1kona o majetku vy\u0161\u0161\u00edch \u00fazemn\u00fdch celkov.<\/p>\n\n\n\n<p>3) T\u00e1to zmluva nadob\u00fada \u00fa\u010dinnos\u0165 d\u0148om nasleduj\u00facim po dni zverejnenia v&nbsp;Centr\u00e1lnom registri zml\u00fav (<a href=\"http:\/\/www.crz.gov.sk\/\">www.crz.gov.sk<\/a>).<\/p>\n\n\n\n<p>4) T\u00e1to zmluva je vyhotoven\u00e1 v \u0161tyroch par\u00e9.
